1. Agreement to Terms

By accessing or using the Hotelingo mobile application ("App") or website ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our services.

Hotelingo is operated by Hotelingo.asia ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use Hotelingo. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

To access Hotelingo's features, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.

4. Subscription and Payment Terms

4.1 Subscription Plans

Hotelingo offers subscription-based access to our content and features. Specific plan details, pricing, and billing cycles are displayed in the App and on our Site.

4.2 Payment Processing

All payments are processed through our third-party payment provider, 2Checkout (now Verifone). By subscribing, you agree to 2Checkout's terms of service and authorize them to charge your selected payment method.

4.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date
• You will be charged the then-current subscription rate upon renewal
• Payment is due immediately upon subscription or renewal
• All fees are non-refundable except as required by applicable law or as explicitly stated in our Refund Policy

4.4 Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice. Price changes will not affect your current billing cycle but will apply upon renewal.

4.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period. You will retain access to paid features until that date.

4.6 Refunds

Refund requests are evaluated on a case-by-case basis. Contact us at support@hotelingo.asia within 7 days of purchase to request a refund. Refunds are not guaranteed and are subject to our discretion.

5. Content and Intellectual Property

5.1 Our Content

All content provided through Hotelingo, including but not limited to videos, text, subtitles, quizzes, images, graphics, and software ("Content"), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Content solely for your personal, non-commercial educational purposes.

5.3 Restrictions

You may not:

• Download, copy, reproduce, distribute, or create derivative works from our Content except as expressly permitted
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use automated systems (bots, scrapers) to access our services
• Share your account credentials or subscription access with others
• Reverse engineer, decompile, or disassemble any part of our services

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Hotelingo, you consent to our data practices as described in the Privacy Policy.

7. Prohibited Uses

You agree not to use Hotelingo to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code, viruses, or malware
• Harass, abuse, or harm others
• Impersonate any person or entity
• Interfere with the proper functioning of our services
• Attempt unauthorized access to our systems
• Use our services for any illegal or unauthorized purpose

8. Educational Content Disclaimer

8.1 No Professional Advice

Hotelingo provides educational content for hospitality workers. Our Content does not constitute professional advice, certification, or qualification. We make no guarantees about employment outcomes or career advancement.

8.2 Content Accuracy

While we strive to provide accurate and up-to-date information, we do not warrant that our Content is error-free, complete, or suitable for your specific needs. Industry practices and regulations may vary by location.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

HOTELINGO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE HOTELINGO.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

10.1 Termination by You

You may terminate your account at any time by canceling your subscription and ceasing to use our services.

10.2 Termination by Us

We may suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Suspected fraudulent, illegal, or harmful activity
• Non-payment of fees
• Extended periods of inactivity

10.3 Effect of Termination

Upon termination:

• Your right to access Hotelingo will immediately cease
• You will not receive refunds for any unused portion of your subscription (unless required by law)
• We may delete your account data after a reasonable period, subject to our Privacy Policy and legal obligations

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Site or App with an updated "Last Updated" date. Your continued use of Hotelingo after changes constitutes acceptance of the modified Terms.

For material changes, we will provide notice through the App, email, or other reasonable means at least 30 days before the changes take effect.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Indonesia, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of Hotelingo shall first be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through the courts of Indonesia.
